By accessing the website at buenaparkdeckandfence.com, requesting an estimate, entering into a service agreement, or using any services provided by Buena Park Deck & Fence ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our Site or services. These Terms and Conditions apply to all visitors, customers, and others who access or use our Site or request our services.
Buena Park Deck & Fence provides residential deck construction, fence installation, and related outdoor structure services in Buena Park, CA and surrounding Orange County cities. Services are performed under a written contract or signed proposal. A request for an estimate does not constitute an agreement to perform work. Work begins only after a written agreement has been signed and any required deposit has been received.
All estimates are provided in writing following an on-site visit. Verbal estimates are not binding. Written estimates are valid for 30 days from the date of issue unless otherwise noted. After 30 days, material costs and labor rates may have changed, and a revised estimate may be required.
The estimate covers the scope of work as described. Work not included in the written scope (including any changes requested after work has begun) will be priced separately and requires written authorization from the customer before that additional work proceeds. We will not perform or bill for out-of-scope work without prior written approval.
Where a building permit is required by the applicable city or county, Buena Park Deck & Fence will obtain the permit on the customer's behalf as part of the contracted work. Permit fees will be disclosed in the written estimate and are charged at cost. The customer is responsible for disclosing any homeowners association rules or deed restrictions that may affect the project prior to permit submission. Delays caused by city review timelines or HOA approval processes are outside our control and do not constitute a breach of contract.
Project start dates are scheduled after a signed contract and required deposit are received. We will provide a projected start date in writing. Start dates may shift due to weather, permit delays, or material availability. We will communicate any changes to the schedule promptly.
If you need to cancel a scheduled project, please notify us in writing as soon as possible. Cancellations made before materials have been ordered or work has begun will result in a refund of any deposit, less any costs already incurred for design or permit preparation. Once materials have been ordered or work has begun, the deposit is non-refundable and the customer may be responsible for costs incurred up to the point of cancellation.
Payment terms are specified in the written contract for each project. Typical terms include a deposit at contract signing, progress payments at defined milestones, and a final payment upon project completion. Final payment is due upon completion of work and the customer's acceptance at the final walkthrough.
Invoices not paid within the time specified in the contract may be subject to a late fee as described in the individual project contract. We reserve the right to suspend work on any project where payments are overdue. The customer is responsible for all reasonable costs of collection, including attorney fees, if payment is not made as agreed.
Buena Park Deck & Fence provides a workmanship warranty on labor as specified in the written contract for each project. Material warranties are provided by the product manufacturers and are separate from our workmanship warranty. Copies of applicable manufacturer warranties will be provided at project completion.
Warranties do not cover damage resulting from misuse, modifications made by others, normal wear and tear, acts of nature, or failure to perform required maintenance as described in care instructions provided at project completion. Any warranty claim must be reported to us in writing within the warranty period.
To the fullest extent permitted by applicable law, Buena Park Deck & Fence and its principals, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of the Site, even if we have been advised of the possibility of such damages.
Our total liability to any customer for any claim arising from a specific project shall not exceed the total amount paid by that customer for the project giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.

While we make reasonable efforts to keep the information current and accurate, we make no warranties, express or implied, regarding the completeness, accuracy, or fitness for a particular purpose of the information on the Site. We prefer to resolve disputes directly and informally. If you have a concern about work performed or a billing issue, please contact us at the information below and we will work in good faith to resolve it promptly.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing formal legal action. Any unresolved dispute shall be subject to binding arbitration in Orange County, California, under the rules of the American Arbitration Association. Each party will bear its own costs of arbitration unless the arbitrator awards otherwise.
These Terms and Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, California.
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
